TOUR TERMS AND CONDITIONS

 

Please note that credit card payments for Island Coachways Limited are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland (“TREKKSOFT”). Therefore, TREKKSOFT will appear as ISLAND COACHWAYS on your credit card statement for the payment of this booking. The domain where you enter and process your payment is owned and operated by TREKKSOFT.

When making a booking you will be accepting our terms & conditions and pay a fixed amount which is non-refundable on behalf of you and all members of your group.

You must be over the age of eighteen years old to make a booking with us.   All children under the age of 16 must be accompanied by an adult.

When booking online, it is your responsibility to ensure that all entered details are correct. If you realise that a mistake has been made after your booking has been confirmed, you must inform us within 12 hours after the receipt of your confirmation. If you fail to do so and subsequently wish to make amendments, fees will apply.

1. Eligibility and Booking Responsibility

  • You must be aged 18 or over to make a booking.

  • Children under 16 years must be accompanied by an adult.

  • When booking online, it is your responsibility to ensure that all entered information is correct.

  • If an error is identified after confirmation, please notify us within 12 hours of receiving your confirmation. Changes made after this time may incur additional fees.

2. Tour Bookings

  • All tour tickets are non-refundable, unless the tour is cancelled by Island Coachways Limited due to unforeseen circumstances.

  • Passengers should arrive at least 10 minutes before departure. Vehicles will be on stand 10 minutes prior to departure.

  • Tours begin with a safety briefing. Your attention is appreciated.

  • Seat belts are available but not legally required under Guernsey law. For your own safety, we recommend using them.

  • These terms do not affect your statutory rights under Guernsey law.

3. Tour Participation

  • Tickets are valid for a specific date and time.

  • Passengers must remain with the same vehicle and driver throughout the tour.

  • Tours run to a set timetable. It is your responsibility to return to the vehicle at the designated time.

  • We cannot return to collect late passengers. Please inform your driver if you plan to leave the tour early.

4. Route and Time Variation

  • We may need to alter our route due to road closures, diversions, or attraction issues beyond our control.

  • In such cases, we will make every effort to provide the best possible passenger experience.

5. Accessibility

  • All coaches have multiple steps on entry. Passengers must be able to board and disembark unaided.

  • Foldable manual wheelchairs may be stored in the luggage compartment.

  • Unfortunately, mobility scooters cannot be accommodated.

  • Some stop-off areas may have uneven surfaces. Please wear appropriate footwear.

6. Travel Insurance

  • UK and EU/EC visitors are reminded that EHIC cards are not valid in Guernsey.

  • We strongly recommend arranging appropriate travel insurance prior to your visit.

7. Animals on Board

  • No animals are permitted on board except guide dogs, and only if notified in advance and agreed in writing.

8. Cancellation by the Company

  • In the event of force majeure (e.g. riot, strike, civil unrest, weather events), we reserve the right to cancel the tour.

  • In such cases, all monies paid will be returned in full without further liability.

  • Where possible, we will attempt to contact passengers using the details provided during booking.

9. Passenger Property

  • We are not liable for any loss or damage to property left on board.

  • Valuable items (e.g., mobile phones) may be passed to Guernsey Police.

  • Other lost property will be held for up to one week, after which it will be donated to charity.

  • Return of found items may be arranged at the passenger’s expense.

  • Passengers are responsible for removing all personal belongings upon leaving the vehicle.

10. Refusal to Travel

  • Our drivers are responsible for the safety of the vehicle and its passengers.

  • Any passenger acting in a disruptive, aggressive, or unsafe manner may be refused boarding or removed without refund.

  • The following are strictly prohibited on board:

    • Chewing gum

    • Alcoholic beverages

    • Illegal substances

    • Smoking (including e-cigarettes)

  • A minimum £100 valeting fee will be charged for damage or soiling caused by food, drink, or illness.

  • If cleaning or repairs exceed £100, passengers will be charged the full cost.

11. Data Protection

  • We collect personal data only for the purposes of managing your booking and contacting you if needed regarding your tour.

  • This may include your name, phone number, email, and address.

  • Your information is securely stored and is not shared or sold to third parties.

  • See our Privacy Policy for full details on how we handle your data.

12. Customer Feedback

  • We value all feedback. If you’re not satisfied with any aspect of our service, please email us at sales@icw.gg.

  • We aim to respond within 5 working days.

13. Governing Law

All contracts made with Island Coachways Limited are governed by the laws of Guernsey.

COACH HIRE TERMS AND CONDITIONS

 

1. COACH HIRE CONDITIONS


These conditions apply whether a contract has been made verbally or in writing. The Hirer contracts with Island Coachways Ltd (“the Company”) on behalf of the Hirer and as an agent for all passengers travelling upon the vehicle. The Hirer expressly warrants that he has the full authority of all passengers to enter into this contract on their behalf and to accept these Conditions of Hire. The Hirer shall indemnify the Company against any loss, claim damage, award or settlement which may be made against the Company, in excess of the exclusions and limitations of liability contained in the Conditions of Hire, as a consequence of any lack of authority upon the part of the Hirer to enter into this contract.


2. QUOTATIONS


2.1 Quotations are given on the basis of the most direct route and on the information given by the Hirer. The route used will be at the discretion of the company, unless the Hirer has requested a particular route, which will be specified on the booking confirmation.

2.2 All quotations are given subject to the Company having available a vehicle suiting the Hirer’s requirements at the time of acceptance of this quotation.

2.3 Quotations are valid for 14 days from issue unless some other period is specified.

2.4 Unless otherwise stated, admission charges and meals are not included in the quoted price.

 

3. USE OF VEHICLE


Unless confirmed in writing by the Company, the vehicle should not be assumed to remain at any point between the outward and return journeys, or to remain available for the Hirer’s incidental use when parked at such points.


4. SEATING CAPACITY

 

The Hirer must not load any vehicle beyond the number of passengers which it is legally permitted to carry.

 

5. CONVEYANCE OF ANIMALS

 

No animals (other than Guide Dogs notified to the company in advance) may be carried on any vehicle, without prior written agreement of the Company.

 

6. CONFIRMATION

 

Normally, written confirmation by the Company is the only basis for the acceptance of a hiring or for a subsequent alteration to its terms. It is the Hirer’s responsibility to check all details on the confirmation to ensure that times, locations and all other relevant information is correct. The Company should be notified immediately of any errors so that these may be corrected. Further confirmation from the Company will then be sent as confirmation of amendment. The Hirer should not assume that the amendment has been made unless written confirmation has been received.

 

7. PAYMENT

 

7.1 Any requested deposit must be paid by the time stated and payment in full must be made before the start of the hire unless the Company has agreed in writing to a variation in this condition. The Company reserves the right to add interest at the rate of 2% compound interest, per calendar month, after the date by which payment should have been made.

 

7.2 The Hirer shall be personally liable for the payment of all deposits and payments but, in the event of failure by the hirer to discharge such deposits and/or payments, the company reserves the right to claim the same from each passenger individually or collectively and each passenger shall remain jointly and severally liable for such payments.

 

7.3 Payments may be made by cheque, cash, most credit and debit cards or BACs transfer. Any bank charges raised against the Company for handling dishonoured cheques or bank transfers will be recharged to the Hirer.  If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this immediately.

 

7.4 We reserve the right to impose a fuel surcharge if fuel prices increase over 20% from 1st July 2024

 

 

8. CANCELLATION BY HIRER

Should the Hirer wish to cancel any arrangement, the following scale of charges shall apply in relation to the total hire charge:

 

8.1 Coach Cancellation Charges

10 days or more prior to hire – loss of deposit
6 - 9 days   10% of hire
3 - 5 days   25% of hire
1 - 2 days   50% of hire
Day of hire 75% of hire
Arrival of coach at departure point 100% of hire

 

8.2 Group Booking Cancellation Charges

Between 30 days and 10 days prior to hire - £5.00 administration charge

6 to 9 days - 25% of hire cost

3 to 5 days  - 50% of hire cost

1 to 2 days  - 75% of hire cost

Day of hire  - 100% of hire cost

 

8.3 Agency Cancellation Charges

The Hirer will be charged by the company such sum as the company has to pay for third party services, ie: hotels, guides and entrance to local attractions, and their cancellation policies will apply. Please note that for certain arrangements and services the provider’s cancellation charges may be higher than those shown above. You may find a 100% cancellation charge will apply as soon as the booking is made. Please ask for full details of their cancellation policy at the time of booking.

 

8.4 Cruise Liner Cancellation Charges

24 to 48 hours prior to hire - 35% of hire

04 to 24 hours - 50% of hire

04 hours or less - 100% of hire

 

8.5 Wedding Hire Cancellation Charges

10 days or more prior to hire - Loss of deposit
3 - 9 days - 50% of hire
1 - 2 days - 75% of hire
Day of hire - 100% of hire

 

8.6 Cancellation due to inclement weather conditions will be charged as above.

 

8.7 The Hirer’s notice of cancellation will be effective when received in writing by the Company.

 

The Company strongly recommends that all passengers take out Travel Insurance.                                                     .

9. CANCELLATION BY THE COMPANY

 
In the event of any emergency, riot, civil commotion, strike, lock out, stoppage or restraint of labour or on the happening of any event over which the Company has no control (including adverse weather and road conditions) or in the event of the Hirer taking any action to vary agreed conditions unilaterally, the company may by returning all money paid and without further or other liability cancel the contract.


10. ROUTE AND TIME VARIATION


10.1 Should a vehicle be detained by the Hirer or taken on a longer journey than that contracted for, the Company reserves the right to make an additional charge commensurate with the costs incurred.

10.2 The vehicle will depart at times agreed with the Hirer and the Company will not be liable for any loss or injury sustained by any passengers who fail to join a vehicle at the appointed time.

10.3 The Company will do its best to accommodate changes to bookings at short notice.  However, such variations may not be possible.

10.4 The Company will endeavour to fulfil all excursions as described in the itineraries. However, in the event of closures of historic houses or visitor attractions the Company reserves the right to change details.

 

11. VEHICLE TO BE PROVIDED


11.1 The Company reserve the right to substitute other vehicles (including those of other operators) or ancillary facilities for all or part of the hiring subject to such substitutes being of similar quality.

11.2 Equipment within the coaches, including microphone and public address systems, is provided at the discretion of the Company unless the quotation specifies that any such facilities will be available. Whilst every endeavour will be made to comply with the Hirer’s subsequent requests the Company cannot guarantee to meet any such requests.

12. BREAKDOWN AND DELAYS

12.1 The company gives its advice on journey times in good faith and does not guarantee the completion of any journey in any specific time and will not be liable for loss or inconvenience caused by the actual journey time.

 

12.2 In the event of delays caused by the late arrival of aircraft or vessels, the Company will do their utmost to collect passengers at the amended time of arrival. If, however, the company is unable to do so due to prior commitments, it will endeavour to get to the airport or harbour as soon as practically possible after the late arrival time. It is the responsibility of the Hirer to ensure that the Company is kept informed of delays and that passengers and/or group leaders have emergency contact numbers for the Company.

 

13. AGENCY ARRANGEMENTS

Where the Company hires in vehicles from other operators at the request of the Hirer, and where the operator arranges ancillary facilities such as admission tickets or any other services provided by another supplier it does so as Agent for and on behalf of the Hirer. Any terms and conditions imposed by such other suppliers through the company shall be binding on the Hirer as if he had directly contracted such services.

 

14. PASSENGERS PROPERTY


14.1 All vehicles hired out by the operator are subject to restrictions as to their carrying capacity as imposed by statute. The Hirer accepts that the driver shall be the sole judge as to whether and to what extent passengers’ luggage and effects can be carried.

14.2 Where size and/or weight of luggage is over the UK national recommend safety guidelines, the driver may request the customer’s assistance to load oversized or overweight items of luggage.

14.3 The Hirer agrees that in agreeing to carry the passengers luggage or effects the Hirer does not carry the same as bailee but such luggage or effects remain at the sole risk of the passenger concerned and the Company shall not be liable for any loss or damage of such baggage or effects of whatsoever nature and howsoever caused including negligence.

14.4  Should notwithstanding the above it be held by any Court of law that the Company becomes a bailee of the luggage and effects then the Company’s liability for loss and damage of whatsoever nature and howsoever caused including negligence shall be limited to the sum of £50.00 per bag, case or package.

14.5 The Company does not accept liability for any damage to or loss of any property left upon the vehicle by a passenger whether or not with the knowledge of the Company, its servants or agents. All articles of lost property recovered from the vehicle will be held for a maximum of one week only. If the property is not reclaimed, it is donated to charity. Mobile telephones, money and other items of value will be deposited with the Guernsey Police. Where possible, at the customer’s request, we will return any items found at the customer’s expense.


15. CONDUCT OF PASSENGERS


15.1 The driver is responsible for the safety of the vehicle. Any passenger whose conduct is in breach of statutory regulations may be removed from the vehicle or prevented from boarding on the driver’s authority. The Hirer will be responsible for the conduct of passengers and for any damage caused to the vehicle by passengers during the hire.

 

15.2 Chewing gum, alcoholic beverages, illegal substances and smoking are not permitted on any of our vehicles and will result in the driver asking passengers, or the party, to leave the vehicle. 

 

15.3 A valeting charge of at least £100.00 will be issued for any damage caused by food, drink or illness. If the damage caused is in excess of £100.00 the full retail amount will be sought.

 

15.4 Any damage caused or incited by the group travelling will result in the Hirer being liable for all expenses incurred.

 

16. JURISDICTION

16.1 Any contract entered into for vehicle hire will be governed by Guernsey Law.

 

This information is correct as at 05th August 2025 and is applicable to booking dates commencing 05th August 2025. These conditions will be reviewed on a regular basis.

 

These general Terms and Conditions are automatically emailed with all confirmations sent to our clients. If you, or your company, have received specific Terms and Conditions relating to your business, these supersede the relevant clauses in the above. Please pay particular attention to cancellation charges, which may vary.
